How sick leave is paid in the UAE

Article 31 of Federal Decree-Law 33 of 2021 gives a worker who has finished probation up to 90 days of sick leave, consecutive or intermittent, for each year of service, in three tiers:

DaysPay
First 15 daysFull pay
Next 30 daysHalf pay
Following 45 daysUnpaid

The daily wage is the monthly wage divided by 30. Days are added up within the same year of service, whether as one long absence or separate days.

Example: basic salary AED 8,000 and allowances AED 4,000 (gross AED 12,000), 20 sick days after probation.

Daily wage = 12,000 ÷ 30 = AED 400.
First 15 days on full pay = 15 × 400 = AED 6,000.
Next 5 days on half pay = 5 × 200 = AED 1,000.
Sick leave pay = AED 7,000 instead of AED 8,000, a deduction of AED 1,000.
On basic salary alone the pay would be only AED 4,666.67.

Frequently asked questions

Do I get paid sick leave during probation?

No. There is no paid sick leave during probation, although the employer may grant unpaid sick leave on the basis of a medical report. The 90-day entitlement starts after probation ends.

Is sick pay calculated on basic or gross salary?

The law says "full pay" and "half pay", and Article 1 defines pay as the basic wage plus allowances, so this calculator uses your gross salary by default. Some employers use basic salary only, and no official statement settles the point, so the calculator shows both.

Does the sick leave balance renew every year?

Yes. The 90 days apply to each year of service, consecutive or intermittent, and the law does not carry unused days over to the next year.

When must I tell my employer I am sick?

Within 3 working days, with a medical report from a medical authority. Late notice may lead to the days being treated as absence.

When is sick leave unpaid?

Article 20 of the executive regulations names two cases: illness caused by the worker's misconduct, such as alcohol or drug use, and illness caused by breaking safety instructions the worker was told about.

What happens after 90 days?

If you cannot return to work after using up your sick leave, the employer may end your service, but must pay all your dues, including end-of-service gratuity.
