Calculate your gratuity after resigning

Basic salary only, without allowances.
Deducted from your service, as the law requires.

The rule: resigning does not reduce gratuity

Article 51 of Federal Decree-Law 33 of 2021 sets one gratuity for full-time foreign employees who complete a year or more of continuous service, without distinguishing between resignation and termination by the employer:

How much do you get if you resign? Worked examples

Service (basic AED 8,000)Days of wageGratuity
1 year21AED 5,600.00
2 years42AED 11,200.00
3 years63AED 16,800.00
4 years84AED 22,400.00
5 years105AED 28,000.00
7 years165AED 44,000.00
10 years255AED 68,000.00

Daily wage = basic ÷ 30. Three years: 3 × 21 = 63 days × 266.67 = AED 16,800.

What changed from the old law?

Under Federal Law 8 of 1980, an employee resigning from an unlimited contract received a third of the gratuity after one to three years of service and two thirds after three to five years, and the full amount only after five years. Since the current law took effect on 2 February 2022, that reduction is gone: an employee who resigns after one year receives the full gratuity under the same formula.

Notice period before resigning

Article 43 requires written notice and working through the notice period in your contract, between 30 and 90 days. Whoever ends the contract without observing the notice owes the other side the wage for the notice period or the part not served — see the notice pay calculator.

What you receive with the gratuity

The employer must pay them within 14 days of the contract ending (Article 53). Prefer Arabic? Use the Arabic version.

Frequently asked questions

I resigned after 11 months — am I owed gratuity?

No gratuity is due before one year of continuous service. You are still owed your pay up to the last working day and cash for unused annual leave, which accrues at 2 days a month after six months of service.

Is gratuity calculated on my last salary?

Yes, on the last basic salary you received when the contract ended, without allowances.

Can my employer deduct anything from my gratuity?

Article 51 allows the employer to deduct amounts you owe under the law or a court ruling, as set by the executive regulations. The law does not allow taking away your gratuity simply because you resigned.

When must I receive my gratuity?

Within 14 days of the contract ending under Article 53. If payment is late, you can file a complaint with the Ministry of Human Resources and Emiratisation.

Does it matter if I move to another company?

No. The reason for resigning does not change the calculation, whether you join another employer or leave the country, as long as you completed a year of service and observed the notice period.
