Indemnity for Kuwaitis

The same formula applies to Kuwaitis and non-Kuwaitis. Since Article 51 was amended by Law 17 of 2018, the employer may not deduct its social insurance contributions from a Kuwaiti worker's indemnity.

Frequently asked questions

How is end-of-service indemnity calculated in Kuwait?

For monthly-paid workers, Article 51 of Law No. 6 of 2010 gives 15 days' pay for each of the first five years of service and a full month's pay for each year after that, on the last full wage (basic plus regular allowances), capped at 18 months' pay.

How much indemnity do I get if I resign in Kuwait?

Under Article 53, a worker who resigns from an open-ended contract gets nothing before 3 years of service, half the indemnity from 3 to under 5 years, two thirds from 5 to under 10 years, and the full indemnity after 10 years.

Is the daily wage the monthly wage divided by 26 or 30?

The law does not state the divisor explicitly. Dividing by 26 is the common practice; the calculator shows both.

When is the indemnity lost?

When the worker is dismissed under Article 41(a), for example for gross error causing serious loss, fraud or disclosing the employer's secrets.

Does a female worker who resigns after marriage get the full indemnity?

Yes. A female worker who ends her contract within one year of marriage receives the full indemnity.
